Does the Italian parliament legalize cannabis?

Does the Italian parliament legalize cannabis?

Does the Italian parliament legalize cannabis?

The discussion on the bill which aims to amend the regulations on cannabis recently began in the italian Chamber. The text, which underwent some changes during the commission process, is supported by the centre-left and the M5s while it is opposed by the centre-right parties.

Among the innovations envisaged by the text is the legalization of the cultivation and possession, by adults and for personal use, of a maximum of four female cannabis plants, as in the Maltese model law which has recently become law. Is it possible, therefore, that the Italian parliament will legalize cannabis? Skepticism is a must, considering our country’s history in this regard, even if recent events in Europe, with Germany in the lead, could lead to some innovations.

Cannabis legalization in Italy, what it is

But what happens in reality if the Italian parliament legalizes cannabis? These are the salient points under discussion:

  • Cultivation for personal use. Adults are permitted to cultivate and possess for personal use no more than four female cannabis plants, suitable for and intended for the production of narcotic substances and the product obtained from them.
  • Modification of prison sentences. At the moment, imprisonment from 6 months to 4 years and a fine of up to 10,000 euros are proposed in the event that the detention and trafficking involveĀ hard drugs; vice versa, imprisonment from 2 months to 2 years and a fine of up to 2,000 euros, when the detention and trafficking concernĀ soft drugs.

The current situation on cannabis consumption in Italy

If the Italian parliament legalizes cannabis, new scenarios could be created in Italy too. According to the European Observatory for Drugs and Drug Addiction (EMCCDA), Italians who used cannabis at least once during 2020 were around 6.5 million. The current Italian legislation establishes the free cultivation and genetic modification of cannabis for the purpose of reducing the concentration of THC (the psychotropic active ingredient) with a limit allowed between 0.2% and 0.6%. This modification makes the so-called “cannabis light”, for curative but not recreational purposes and allows cannabis growers to produce and sell to specific retailers.

In 2019, the so-called Legal Cannabis DDL was approved which provides, for a private individual, the possibility of self-growing up to a maximum of 3 cannabis plants and of keeping a maximum of 15 grams of marijuana at home; Outdoor consumption of cannabis has a maximum permitted limit of 5 grams. As regards associations and clubs, following the necessary permits and communications required in the Prefecture, the cultivation and possession of cannabis is significantly higher.

The objective of such legislative measures is also to eradicate organized crime and to break down the black market for the sale of cannabis. In fact, under a state monopoly, there would also be economic regulation and the consequent taxes on its production and sale. Therefore, if the Italian parliament legalizes cannabis, adults will be allowed to cultivate, produce and possess, in addition to personal consumption and not for sale, marijuana plants up to a maximum of 4 female plants.

Cannabis legalization Germany

Cannabis legalization Germany

Great and in some ways unexpected news regarding cannabis legalization in Germany. The German Minister of Health,Ā KarlĀ Lauterbach, has announced that the draft law on legal cannabis for adult use within the country will be completed by 2022; on the other hand, the commissioner for drugs,Ā BurkhardĀ Blienert, plans to consult industry experts to contribute to the drafting of the law and arrive at its effective enactment during 2023. A real acceleration, therefore.

Currently in Germany only pharmacies can supply therapeutic cannabis to patients, the use of which has been legal since 2017. If the law were to be approved, Germany would constitute the largest legal European market for sales and, probably, also for production of regarding cannabis.

Cannabis legalization: different objectives

To obtain cannabis legalization in Germany it will be necessary to pursue some specific objectives. Among these, the government’s general objective is first and foremost to:

  • Ensure the protection of minors;
  • Ensure product safety promote education;
  • Rejecting the illegal market.

Therefore, youĀ need a nationwide sales infrastructure and this will not be possible if you simply allow sales to existing pharmacies; Private commercial establishments will certainly also be necessary.

Sales via e-commerce and online distribution will also need to be implemented, as all processes relevant to the protection of minors and consumer education can also be managed online. It is also essential to standardize regulations throughout the country and not have different rules in the 16 states that make up the political and administrative division of Germany.

Not just recreational use for cannabis

The discussion on cannabis legalization in Germany does not only concern the drug market, where cannabis is used for recreational use. The use of the plant also has other areas of use, generating a flow of business that is still in its germinal state but with enormous potential. For example, as a replacement for plastic in some automotive components.

In this regard, several companies are working between the United States and Colombia, to minimize the carbon footprint and replace polluting plastics with those of biological origin using cannabis. Not only can hemp be used to build cars, but also for fuel, food and plastic. In the United States some of the most prestigious automotive brands, such as Jeep, Dodge, Chrysler and Citroen are already using hemp plastic-based components. Not only plastic, in the use of hemp, but surprisingly also food.

In fact, cannabis is also being used as a natural substitute for animal meat in the food sector. Also in the United States, an ingredient has been created that will be used to produce meat-like foods. This new food compound is called PurHP-75, a hemp seed protein ingredient that contains 75%Ā protein including the nine essential amino acids. The road to cannabis legalization in Germany therefore opens up infinite market possibilities on the European continent for the use of this plant.

Cannabis social club Malta

Cannabis social club Malta

Malta is the first European country to completely legalize both the cultivation and possession of cannabis for personal use and to provide for the opening of Cannabis Social Clubs Malta. TheĀ cannabis social clubsĀ are regularly registered and declared non-profit associations. They are made up of adult cannabis consumers who, for medical or recreational purposes, organize themselves in the production of the same to satisfy their personal consumption, thus removing cannabis from the street black market while protecting responsible consumption prohibited for minors.

Inside the clubs it will be possible to consume marijuana legally, and you will also meet and be able to interact with experts in the sector or simply with people who share your same interests.

What the new Maltese law says

The law promulgated at the end of 2021 provides very interesting aspects regarding the possession and consumption of cannabis, the main ones being:

  • It will be possible to grow up to 4 cannabis plants per person and personal possession in a public place will be allowed up to 7 grams, without incurring any sanctions.
  • However, anyone found with a greater quantity of between 7 and 28 grams will not be subject to a criminal sanction but will be subjected to a sanction with fines of between 50 and 100 euros.
  • Consumption in public and in front of minors is also sanctioned.

The new law also provides for the implementation of a social cultivation and distribution system, through the opening of cannabis social clubs Malta; these associations will be made up of a maximum number of 500 members, each of whom will be entitled to a personal daily quantity not exceeding 7 grams for a maximum of 50 grams per month.

Social clubs are starting on the model of the Spanish ones

Born in Spain within the framework of the law, but also present in other European countries such as Belgium, cannabis social clubs have been made legal in Uruguay and hypothesized in some US legislation; with the new law approved in Malta it will be the first time that a non-commercial system will be tested as the only place of legal distribution of cannabis. All this in the cannabis social clubs Malta.

The social route to legal cannabis proposed by the new Maltese law is very interesting because it creates a non-profit alternative to the legal market, thus depriving it of the risks linked to the excessive commercialization of a substance. It also allows you to build real social and cultural networks that encourage the sharing of experiences, thus providing better awareness of its uses and effects. The cannabis reform also hits European shores.

Starting from the small island in the heart of the Mediterranean with its brand new cannabis social clubs Malta, the approval of a similar regulation is also awaited in Luxembourg but above all in Germany. The German decision to quickly arrive at legal regulation of cannabis is still recent news. If this were to actually happen, the wave of the new Maltese law would risk becoming a real tsunami at a European level, implying profound changes at a social, cultural, political and even economic level.
